1. Who are we, and what is this about?

We are VITO New Energies Solutions SA, operating under the brand name VITO Energies, based in Bugeon at 2087 Cornaux, and we are responsible for this website. This is our Privacy Policy (“PP”), in which we provide you, as a data subject, with the information you need to exercise your rights and to ensure that your data is processed transparently.

This Privacy Policy serves as the basis for how we process all personal data we receive in connection with your use of and interaction with this website or any other online presence we manage, including our social media accounts and our applications (“apps”) (collectively referred to as the “website”).

2.3. If you contact us by email or phone

If you decide to contact us by email or phone, you agree that we may process your email address, last name, first name, your title, your organization (if applicable), your phone number, and your proposed appointment time (if applicable), as well as the content of our conversation, for the purpose of communicating with you until we are satisfied that you are satisfied, and that we will subsequently archive or delete the data in accordance with legal requirements.

2.4. If you open a customer account with us

To use some of our services, you can open an account. To do so, we need your personal information; otherwise, we will not be able to open an account for you or provide you with our services.

Creating and using an account is optional. To do so, we need your last name, first name, title, organization (if applicable), phone number, and email address. We then process the date and duration of your registration, your account settings and preferences, your interaction with the website, your use of the services, and the creation and management of your customer account, including any communication regarding this.

If you have an account, you are free to add additional personal information to your profile—such as your date of birth—which you can also delete.

We process this account data until you delete your account, and then we retain it for as long as we are required to do so by law or contract. Any account data that we are not required to retain is anonymized or deleted for statistical analysis purposes.

2.5. When you purchase our services

To purchase our paid services, you or your organization must enter into a contract with us. To do so, we need information such as your last name, first name, title, organization (if applicable), phone number, email address, shipping address, billing address, and payment method. This allows us, on the one hand, to verify the customer relationship with you or your organization and, if applicable, to establish it. On the other hand, it allows us subsequently to provide the services or deliver the goods requested by you or your organization for the purpose of fulfilling the contract.

We will retain all of this information in accordance with legal requirements. We reserve the right, after your purchase as an existing customer, to notify you via email about our offers for goods or services similar to those you have already purchased, to invite you to events, or to ask you to rate us and evaluate our services, provided you do not object. In addition, we analyze the purchasing behavior of our existing customers on an individual and segmented basis in order to tailor our offerings to the projected demand. This includes use for advertising purposes on social media (e.g., for Lookalike Audience campaigns). If you use your customer account for your purchases, we will associate your transactions with that account.

For the performance of the contract, delivery, credit checks, analysis, communication, and payment by invoice or credit card, we rely on our partners, who are themselves subject to data protection laws. 2.6. If you become our offline customer

To become our customer, you or your organization must enter into a contract with us. To do so, we need information such as your last name, first name, title, organization (if applicable), phone number, email address, shipping address, billing address, and payment method. This allows us to verify the customer relationship with you or your organization and, if applicable, to establish it.

In addition, this allows us to provide the services requested by you or your organization for the purpose of fulfilling the contract. Furthermore, we create a file regarding you or your organization, which includes your contact information, the work performed, transactions, communications, documents created or received, time spent, as well as information for billing and accounting purposes. We will retain all of this information in accordance with legal requirements.

2.7. If you receive free products (e.g., downloading documents) from us

We offer various products on our website that you can download or try for free. To access them, we ask that you provide us with your email address. If you choose to receive our free products, you agree that we may process your email address and your interaction with our newsletter in order to send you our newsletter tailored to your interests via email, ensure you receive it, and potentially improve our offerings based on your interaction. This includes use for other advertising purposes on social media (e.g., for Lookalike Audience campaigns). 2.9. If you are applying for a job with us

You can apply to us via email. By doing so, you agree to our processing of your email address, last name, first name, title, address, all data from your resume, your diplomas and certificates, your references, as well as any other data and letters you send us as part of your application, in order to review your application, communicate with you regarding it, and, if necessary, contact your references. You may revoke your consent at any time. If your application is not successful, we will delete your documents no later than one year after submission. For communication via email and telephone, the relevant provisions of this Privacy Policy apply.

2.10. If you follow us on social media

If you decide to follow us on social media and, if applicable, contact us through those channels, you agree that we may process your username to manage and analyze our followers (including for advertising purposes) as well as the content of any interaction you may have with us or our content. You may unfollow us at any time, effective immediately.

We are jointly responsible for the operation of such a presence with the operator of the relevant platform: we are responsible for processing your data as described above, and the platform operator is responsible for processing your data in accordance with the participation agreement between you and the platform operator.

4. Do we transfer your personal data abroad?

We work with various partners in Germany and abroad (see above). In principle, these partners are located in countries that provide an adequate level of data protection. If data transfers to certain countries require additional protection, we ensure this by agreeing with such partners on standard data protection clauses approved by the authorities or by relying on the self-certification of such partners within the framework of the relevant agreements.

5. What are your rights with respect to us?

You have the right to:
